You are hereby notified that the above-named Respondent has been found, upon evidence gathered over a period of considerable patience, to be in breach of the following provisions:
- § 30.7aEncroachment by vegetation. Permitting growth to cross a boundary line that has not moved.
- § 30.7bDeprivation of daylight. Achieving a height at which a neighbouring window no longer receives afternoon sun.
- § 30.7cDeposit of leaf matter. Shedding the entire annual output onto the other side of the fence.
- § 30.7dRoot incursion. Sending roots beneath a boundary toward a patio laid at some expense.
- § 30.7eThe overhanging branch. Maintaining a limb at exactly head height above a path in regular use.
It is therefore ordered that the Respondent cut the growth back to the boundary as it was originally surveyed, effective immediately. You are advised that continued conduct of this nature will be escalated. Compliance will be monitored. There is no appeals process, and there is no one to appeal to.
